RoadGuard provides free legal assistance for all road users who are involved in no fault accidents in Western Australia.

We will provide you with practical support to get you back on the road as soon as possible, plus the legal muscle to help you reclaim your losses from the driver at fault.

And it doesn’t stop there: your RoadGuard membership covers you for an accident in any vehicle and provides your passengers with access to free legal advice if they need it.

Terms and Conditions


  • RoadGuard is a legal support and uninsured loss recovery service subject to the following terms and conditions:
  • Once registered as a member, you will be eligible to use the RoadGuard services.
  • The RoadGuard service applies to road traffic accidents occurring in Western Australia where the member is not at fault and where the other driver can be identified and is insured.
  • RoadGuard only applies to civil claims for expenses, costs, losses and compensation arising from road accidents. It does not extend to the provision of any services or advice in relation to any criminal or other matters arising from any such accident or for accidents other than on roads in Western Australia.
  • To pursue a claim, we must be satisfied at all times that you have reasonable prospects of success.
  • You must co-operate with us and our service providers, and be truthful, at all times.
  • We may appoint or recommend service providers (e.g. solicitors, hire car company, repairer, etc.) on your behalf.
  • Where your claim is approved, your legal adviser will attempt to negotiate settlement with the third party and/or their insurer.
  • Where such negotiations do not result in a reasonable settlement, your solicitor will advise you about issuing court proceedings to recover your losses.
  • If you have a claim for personal injury which is accepted by your solicitor, your solicitor will act on a no win no fee basis.
  • You must comply with your statutory reporting obligations.

  • RoadGuard is a legal advisory membership service, not an insurance policy.
  • We may from time to time implement changes to improve the service we offer to our members. If we do so, we will notify our members.
